Student sues Univ. of St. Thomas over 1-year suspension

ST. PAUL, Minn. (KMSP) - A University of St. Thomas student is suing the school after its decision to suspend him over a sexual encounter, even though no criminal charges were filed.

Minneapolis defense attorney Joe Tamburino says the schools ruling all comes down to title nine and the procedures it requires.

“Under Title IX, the school is required to have some type of a process, so most of the time they put together a hearing that isn’t judges or attorneys, it’s basically school administrators and students,” Tamburino said.

And in this case the decision was made by the school that there were grounds to suspend the student despite St. Paul Police declining to press charges.

Court documents show the student feels he was not treated fairly. The university has denied the allegations and on Monday filed an emergency motion to delete and seal some of the student’s allegations.
