Judge determines Wis. mother with amnesia competent to stand trial

A Pierce County district court judge has ruled that the Wisconsin mother accused of using Facebook messenger while driving moments before a crash that killed three young girls is fit to stand trial.

Kari Jo Milberg's attorney had argued earlier this week that due to her amnesia she shouldn't have to go to trial. Medical experts agreed that she can not remember the crash. Milberg suffered a traumatic brain injury from the crash.

In the judge's ruling, he explained if a defendant suffering from amnesia is otherwise competent, the trial can be permitted to continue. At the end of the trial, if Milberg is convicted, she can make a motion if, in light of her disability, she received a fair trial.
