Material witness in Fitch trial behind bars

The material witness who had a warrant out for his arrest in the first-degree murder trial of Brian Fitch is officially behind bars. Fitch is accused of killing Mendota Heights Police Officer Scott Patrick in July.

Jacob Kenneth Martin Hayes from West St. Paul has been booked into the Dakota County Jail. He allegedly disobeyed a subpoena and is charged with felony contempt of court. He reportedly turned himself in.

It is unknown what Hayes would specifically testify to, but he was wanted by police on Wednesday.

Wednesday's proceedings also revealed a tape that captured the fatal shooting, a key piece of evidence for the prosecution, along with more updates from the jurors selected from a pool of 93.
